Legal News - New law on authorisation in the area of electrical, plumbing and sewer installation

The new law on the authorisation in the area of electrical, plumbing and sewer installation entered into force on 2 June 2014. At the same time, the Danish Safety Technology Authority launched a TV-campaign containing the message ”before you do-it-yourself – see what you are allowed to do on sik.dk”.

Many Danes do all kinds of handiwork in their houses but a lot of them are unsure as to when they should call an authorised craftsman in connection with electrical, plumbing and sewer installations. The new campaign ”before you do-it-yourself – see what you are allowed to do on sik.dk” launched by the Danish Safety Technology Authority aims at encouraging people to check on sik.dk, if they are allowed to do handiwork themselves or if they have to call an authorised craftsman. There are many “do-it-yourself” tasks that do not require authorisation, but for a lot of electrical, plumbing and sewer installations, authorisation is needed in the interests of safety, health and environment.

The new Authorisation Law that entered into force on 2 June 2014 shall further provide simpler rules for authorised craftsman. The law establishes the possibility to apply for half-authorisation limited to certain defined areas, as for example photovoltaic installation, electrical installation and sewer installation in homes. Those half- authorised undertakings will have the same competences within their authorisation area as fully authorised undertakings. The Danish Safety Technology Authority has therefore created a new authorisation register, which consumers can use to easily find out what authorisations have been issued to the undertakings nearby.

Furthermore, the personal liability of an Electrical Foreman doing electrical installations was omitted from the scope of the Act. In the future only an undertaking will be held liable, not an Electrical Foreman. The personally liable individual in a sanitary-heating-climate company will from now on be the person with the technical responsibility. You only have to apply once for the authorisation as a “technically responsible person” and you will be able to keep that title, even after a change of job.
