Flash-Update: Refunds of IEEPA Tariffs

The ruling issued on February 20 by the Supreme Court of the United States regarding the so-called reciprocal tariffs based on the International Emergency Economic Powers Act (IEEPA) represents a significant turning point in U.S. trade policy. The Supreme Court has clarified that the U.S. President is not authorized to unilaterally impose comprehensive tariffs on a variety of trading partners by invoking emergency powers.

This ruling opens up new opportunities for numerous companies with business relationships in the U.S. to reclaim tariffs already paid (Refunds). However, there are significant uncertainties regarding eligibility, formal requirements, deadlines, and the practical execution of refund applications to U.S. Customs authorities.

The U.S. Customs and Border Protection (CBP) was mandated by court order in early March 2026 to provide a system for refunding tariffs deemed illegal. This new system (ACE Portal) will go live on April 20, 2026, and allows eligible parties to initiate a formal refund process online.
